This morning, the Direzione Investigativa Antimafia – Section of Salerno has carried out a confiscation order issued by the Section Review and Preventive Measures of the Court in Salerno, after a joint proposal made by the Public Prosecutor at the Court of Nocera Inferiore and the D.I.A. Director/Direzione Investigativa Antimafia, institution within the Department of Public Security. The order targets real estate properties totalling over 2 million euros linked to MONTELLA Carlo, currently detained for numerous final convictions for murder with more than one aggravating circumstance, criminal camorra-type association, usury, extortion and other offences.
The enforcement of the order represents the success of a complex and in-depth investigation carried out by the D.I.A. Section in Salerno aimed at reconstructing the social dangerousness of the person involved and at identifying his various immovable assets and other properties.
The asset-related investigation conducted by the D.I.A. Section in Salerno highlighted a disproportion between his assets and the income declared by the affected person and his relatives. Thus, the Court Section Review and Preventive Measures in Salerno established the qualified social dangerousness of the affected person, on the basis of numerous final convictions for very serious offences and of a previous personal-related order of preventive measures. The latter could not be carried out due to his detention, as well as his membership to the camorra clan “Tempesta”, a group belonging to the well-known criminal organization “Nuova Famiglia”, active in the area Nocera-Sarno. Consequently, the Court ordered against MONTELLA the asset-related preventive measure of confiscation.
This prevention initiative is particularly important considering that for years the affected person deceived the Court in order to avoid a number of judicial proceedings since the 90s. In short, MONTELLA for years pretended to have an illness resulting in a severe cognitive deterioration. The pathology was confirmed by a number of medical-legal and psychiatric expert evidence, so that he was believed to lack the capacity to stand trial, that in turn caused for years the postponement of numerous pending judicial proceedings relating to very serious crimes in the pleading stage. The outcome of the investigations conducted by the Prosecutor’s Office in Nocera Inferiore during this period of time, was subjected to an expert psychiatric-medical consultant. So, it turned out that the serious disabling pathology affecting the person, incompatible with the current criminal activities were undeniably carried out by MONTELLA. In this way, the judicial proceeding, which for such a long time was suspended, could be resumed. Since then, a number of final convictions for very serious offences against that person were delivered. Neither the long suspension nor the time passed after the offences committed, stopped the investigators from tracing back the assets of illicit origin linked to the person, on the basis of his social dangerousness and his inability to earn an income. Due to the above-mentioned facts, the Court in Salerno issued a confiscation order of a number of real estate properties, comprising a real estate complex (Parco Concetta), made up of some apartments, garages and unbuilt areas in Angri and another real estate property (Villa Concetta C) in Sant’Egidio del Monte Albino.
Furthermore, the confiscation for an equivalent value was ordered of approx. 160,000 euros.
